Welcome to WAKE. By downloading, installing, or using the WAKE application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using WAKE, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

WAKE is a wellness application designed to help users establish morning routines through guided audio sessions and light exposure practices. The App provides:

• Guided audio wake-up sessions
• Progress tracking and streak monitoring
• Customizable alarm notifications
• Session history and feedback tracking

3. Free Trial and Subscriptions

Free Trial: WAKE offers 3 free sessions to new users. After completing your free sessions, a subscription is required to continue using the App.

Subscription Plans:

• Monthly subscription
• Annual subscription
• Lifetime access (one-time purchase)

Payment: All payments are processed through Apple's App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases.

Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your App Store account settings.

Refunds: Refund requests are handled by Apple according to their refund policy. We do not process refunds directly.

4. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer, modify, or distribute the App
• Not use the App in any way that could damage or impair its functionality
• Ensure your device meets the minimum requirements for the App

5. Intellectual Property

All content in WAKE, including but not limited to audio recordings, text, graphics, logos, and software, is the property of WAKE and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

WE MAKE NO GUARANTEES REGARDING:

• Your ability to reduce caffeine consumption
• Improvements in your morning routine or energy levels
• Any specific health or wellness outcomes

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAKE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

9. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WAKE regarding your use of the App.
